Company Porsche Česká republika s.r.o, identification number: 25654012, based at Prague 5 – Jinonice, Radlická 740 / 113d, zip code 15800, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 58399 (hereinafter Porsche) declares that all processed personal data are considered to be strictly confidential and handled in accordance with applicable data protection laws. The security of your personal data is a priority for Porsche.

Porsche is the controller of your personal data within the meaning of the General Data Protection Regulation (Regulation (EU) 2016/679), i.e. it collects, stores and uses (and otherwise processes) your personal data to perform their business activities (the individual purposes for which personal data are processed are specified below).

This Privacy Policy applies to all personal data collected by Porsche during your use of the Porsche Website (hereinafter "the Website") and further on the basis of performance of the contract between you and Porsche or on the basis of performance of a contract between you and one of the Porsche's contractual partners (dealers and service partners), legal obligations, Porsche's legitimate interest, or your consent to the processing of personal data, through the Internet or for example when buying or servicing motor vehicles.

The Privacy Policy describes the purposes of processing your personal data, ways of using your personal data, informs about individual categories of processed personal data, individual recipients of personal data, the period of personal data retention, and your rights in relation to the protection of personal data.

PURPOSES OF PROCESSING OF PERSONAL DATA

Your personal data may be processed by Porsche primarily for the following purposes:

  • Performing a contractual relationship (for example, when signing a purchase or service agreement);
  • Managing user accounts of the data subject (for example, when entering personal data in the electronic forms available on the Website);
  • Sending business messages and offering products and services (Porsche can send a commercial message and offer products and services via e-mail, SMS or phone call;
  • Accounting and tax purposes (performance of legal obligations in the sense of accounting and tax legislation);
  • The fulfilment of other statutory obligations (among other legal duties performed by Porsche include, for example, the provision of information to law enforcement authorities or other public authorities).

Personal data is processed in Porsche both manually and automated. The automated processing of personal data takes place for the purpose of fulfilling a contractual relationship with you, in particular to ensure internal processes within Porsche and within Porsche's contractual partners that are necessary to ensure the production, distribution and delivery of motor vehicles and services. The automated processing of your personal data also occurs when your consent to the processing of personal data for personalized marketing communications has been granted by you; in these cases, profiling may also occur.

Porsche is authorized to collect, store and use certain information through automated means such as statistical information whenever you visit the Website.

RECEIVERS OF PERSONAL DATA

In Porsche, your personal data are only accessible to authorized employees or to individual Porsche processors and personal data controllers, to the extent strictly necessary for the fulfilment of the individual purposes of the processing, as the case may be, upon consent to the processing of personal data.

Under certain conditions, we may then be authorized to transfer some of your personal information under applicable law, such as law enforcement agencies or other public authorities.

TIME OF RETAINING PERSONAL DATA

We process and store your personal data for as long as it is necessary to ensure all rights and obligations arising under the applicable contractual relationship, and for as long as Porsche is obliged as a personal data controller to keep personal data in accordance with generally binding legal regulations or for as long as you have given us permission to process. In other cases, the processing time is the result of the purpose of processing or is determined.

We process the personal data according to the purpose of its processing after the specified period of time:

* Porsche is authorized to process your e-mail address within the meaning of Section 7 (3) of Act No. 480/2004 Coll., On Certain Information Society Services and on Amendments to Certain Acts (Act on Certain Information Society Services), as amended, in order to the dissemination of business communications regarding your own products or services (for example, by means of an information bulletin or newsletter) if you did not reject such communications.

RIGHTS OF DATA SUBJECTS

As a data subject, you have the rights listed below, which for you derive from the law, and which you can apply at any time. This is the right to (i) access personal data, (ii) to correct inaccurate or false personal data, (iii) request clarification in the case of suspected personal data privacy or personal data processing (iv) the deletion of personal data if personal data are no longer required for the purposes for which they were collected or otherwise processed or if it is found to have been processed unlawfully; (v) to limit the processing of personal data; (vi) the portability of the data; and (vii) the right to object after which processing of your personal data will be terminated unless it can be proven that there are serious legitimate reasons for processing that outweigh the interests or rights and freedoms of the data subject, particularly, if it is the reason for the enforcement of legal claims. At the same time, you have the opportunity to contact the Office for Personal Data Protection (www.uoou.cz), to which you may submit a possible complaint.

  • Right of access to personal data:if you want to know if Porsche processes personal data about you, you have the right to obtain information about whether your personal data is being processed and, if so, you also have the right to access your personal data. In the event of a repeated request, Porsche will be entitled to charge a reasonable fee for a copy of the personal data provided. We will inform you about this.
  • Right to correct inaccurate and untrue personal data:if you feel that Porsche is processing inaccurate or untrue personal information, you have the right to request a correction. Porsche will do the repair without unnecessary delay, but always with regard to technical options.
  • Right to demand explanation:if you suspect that Porsche will by processing your personal data interfere with the protection of your personal and private life or that your personal data is processed in violation of law, you may request an explanation from Porsche
  • The right to erase:in case you request a deletion, Porsche will erase your personal data if (i) it is no longer needed for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no prevailing legitimate reasons for processing, or (iv) Porsche imposes a legal obligation.
  • The right to limit the processing of personal data:if you are not interested in deleting, but only temporarily restricting the processing of your personal data, you may request a limitation on the processing of your personal data by Porsche.
  • Right to data portability:in case that you want Porsche to forward your personal data to a third party, you can exercise your right to data portability. In the event that the exercise of this right would affect the rights and freedoms of third parties, Porsche will not be able to comply with your request
  • Right to object:you have the right at any time to object to the processing of personal data processed for the purpose of carrying out a public interest task or in the exercise of public authority or for the purpose of protecting the legitimate interests of Porsche. In the event that Porsche does not prove that there is a serious legitimate reason for processing that outweighs your interests or rights and freedoms, it will terminate the processing on your objection without undue delay.
